1 General

Preamble: Parkifind is a nationwide portal for finding parking spaces at airports. The website is operated by Mr Nikola Asic, Talstraße 130 70794 Filderstadt On the parkifind.de website, parking spaces are displayed and arranged over the Internet for specific locations, primarily at airports. The data is entered manually in our Internet directory. We comply with the legal requirements of data protection (current legal situation) and adapt them accordingly in the event of changes in the law.

After sending, the data is entered into our database and checked by our employees for functionality and verification.

At this point, we would like to point out that we are not responsible for the correctness of the data published in the database and have no influence on the content of the linked websites. For this reason, we now expressly distance ourselves from all content on all linked pages in this web directory.

The user has no entitlement to include a URL in the database or to an exposed ranking position in the directory or other services of this web directory. The work of your entry in the result lists cannot be influenced and is solely dependent on the variety of your services or your specified parking space prices, depending on how the visitor sorts the results.

The service points we have selected for better sorting of the companies are individually selected by us and correspond to our personal feelings when choosing the right parking space provider.

2 Conclusion of contract

The presentation of the parking facilities/parking space providers in the booking system does not represent a legally binding offer but a non-binding online catalogue. By clicking on the button ["Book subject to payment"] for the respective provider, you make a binding reservation for the reservation contained in the shopping cart.
The confirmation of receipt of your reservation is sent together with the acceptance of the reservation immediately after it has been sent by automated email. With this email confirmation, the contract between the parking space provider and you has come about.
We save the contract's text and send you the reservation data and our terms and conditions separately by email. You can view your past bookings in our customer login area, provided you have registered with us.

3 Costs

The use of our Internet directory is subject to a fee for all car park operators.
We charge each booking mediated by Parkifind.de to the relevant parking lot operator. The price per booked booking is contractually regulated accordingly by the parking space provider. If the car park operator does not adequately fulfil his obligation to update his prices and parkifind.de constantly, therefore, finds price discrepancies, the car park operator's prices will be updated accordingly by parkifind.de. The car park operator will be charged a flat rate of EUR 40.00 plus the applicable VAT. Calculated from currently 19%. This applies to changing all prices daily, regardless of how many are modified.

4 Cancellation of the booking

Parking operator:

Should you, as the car park operator, have to cancel a booking, we request that you send an email with the booking to be cancelled and the reasons. Upon receipt of the email and a review, you will not be charged the commission amount in the event of a valid cancellation. A cancellation is possible up to maximum 14 days after the end of the month on the day of the booking. All later cancellations can generally be considered not. Cancellations after the end of the month are usually granted in the form of replacement cancellations in the following month. To prevent misuse, the car park operators must send us the relevant customer data in case of a cancellation. These are checked by us on a case-by-case basis and treated confidentially, and they are not passed on to unauthorized third parties or made accessible in any other way. Furthermore, in cancellations by the car park operator (e.g. due to a lack of parking spaces), the car park operator must send the cancellation email for the customer to us as an additional party to [email protected]. Bookings cancelled with fraudulent intent will result in the car park operator's account being terminated immediately. In addition, we charge a processing fee of 120€ plus the applicable VAT. from 19. We assume that this regulation does not apply due to the sincerity of our customers.

To meet the cancellation deadline, it is sufficient for you to communicate regarding your exercise of the right of cancellation before the cancellation period has expired.
Consequences of revocation
If you revoke this contract effectively, we have all payments that we have received from you, including the delivery costs (except the additional costs resulting from the fact that you chose a different type of delivery than the cheapest standard delivery offered by us have chosen) to be repaid immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction unless something else was expressly agreed with you; under no circumstances will you be charged for this repayment.
Suppose you have requested that the services should begin during the cancellation period. In that case, you must pay us a reasonable amount that corresponds to the proportion of the services already provided up to a point in time at which you informed us of the exercise of the right of cancellation about this contract Compared to the total amount of the services provided for in the agreement.
The right of withdrawal does not apply to contracts for the provision of services in the areas of accommodation for purposes other than residential purposes, transport of goods, motor vehicle rental, delivery of food and beverages and the provision of other services in connection with leisure activities if the contract for the provision of a specific date or period.
By the provisions of travel contract law, the lessee of a parking opportunity has the right to cancel the booking up to 24 hours before the arrival time (start of parking) communicated with the reservation instead of the right of withdrawal. In the event of a timely and effective cancellation, the entire fee for the parking opportunity will be waived, or the fee paid in advance will be reimbursed in full.

If the parking process is not started without prior, effective cancellation, 95% of the agreed rent for the reserved parking space will be forfeited as agreed flat-rate compensation; 5% of the rent will be refunded. However, the customer reserves the right to prove that the actual damage suffered by the provider is lower.

5 Termination

You can terminate your account at any time in writing by email or post without giving reasons. Cancellations made by telephone must also be confirmed by email. We will then confirm the termination again accordingly so that the customer has security.

The cancellation must be declared accordingly with a notice period of one month to the end of the month.

If a third party has entered your website without your consent, please inform us immediately by email, post or telephone, and we will remove the relevant data immediately. You can change your data at any time with the access data given to you under "Settings" in your account.

6 Customer reviews

In principle, every car park customer has the opportunity to leave a customer rating for the car parks entered here. The prerequisite is that the reviewer has made a parking space reservation. This must be proven by a booking confirmation if requested by Parkifind. If the authenticity of a customer cannot be verified without a doubt (by the customer or car park operator), the corresponding ratings will be deleted immediately.

Deliberately false ratings given by car park operators or their representatives in their interest - so-called "fake" ratings - can lead to the cancellation of the relevant car park entry on Parkifind.de. We also reserve the right to take legal action. For "fake" reviews from the parking lot operators or their agents, we charge a processing fee of 100.00 EUR plus the applicable VAT. per "fake" rating. Self-reporting of false reviews to our editorial team can lead to mitigation or suspension of the processing fee.

7 Privacy

Parkifind.de will observe all data protection requirements, in particular the provisions of the Data Protection Act. More details can be found in the data protection declaration (deposit).

7.1 Third-party data usage through API

Parkifind.de is authorized to forward personal customer data to third-party applications via API on a client request to ensure the proper processing of inquiries and bookings. This transfer occurs exclusively for the purpose of processing inquiries and bookings and is subject to the applicable data protection regulations. Third-party is entitled to process the above data to ensure the proper management and provision of the parking services.

8 payment terms

For end customers:

Parkifind.de will issue an invoice to the customer, which will be sent by e-mail if the relevant details are not already included in the confirmation e-mail.
Payment can be made optionally and in advance by PayPal, Sofort Banking, Giropay, credit card (Visa / Mastercard / American Express/Carte Bleue), collection, Maestro debit card or as cash payment or payment by card directly upon arrival with an employee of the respective parking space provider. However, when paying by card, there are additional costs: MasterCard, Visa, Carte Blue, Maestro Debit card: Surcharge of 3% of the value of the goods. American Express: Surcharge of 3.5% of the value of the goods. Not all parking providers offer all payment options.

The payments are carried out securely via the payment service provider, which offers you various payment options.
Prepayments or credit card debit orders will be taken into account when billing.
Your credit card account will be charged upon completion of the reservation unless you have chosen to pay on arrival.
Prices on the invoice are always retail prices, including all taxes and service costs. Sales tax is shown separately for entrepreneurs.
In the event of late payment, the customer, who is a consumer, is obliged to pay default interest of 5% above the base interest rate to Parkifind.de unless Parkifind.de can prove a higher interest rate. For customers who are entrepreneurs, sentence 1 applies with the proviso that the default interest rate is 8% above the base rate.

For car park operators:

Parkifind.de will bill you monthly at the end of the next month. Billing is from the first to the last day of each month.

The invoice will be sent to the car park operator on their stored e-mail account. Each invoice is to be paid within seven days of receipt. If no payment can be determined seven days after the invoice has been sent, the service will be paused for the time being. End customers cannot book the operator via this portal at this time. The car park operator can be activated if payment is received later. In the case of permanent and repeat on-payments, we reserve the right to terminate the contractual relationship.

9 Warranty and liability

The guarantee for the provision of services is based on the requirements of the German Civil Code. The limitation period is three years for consumers and two years for entrepreneurs. The statute of limitations begins at the end of the year in which the claim arose, and the creditor became aware of the circumstances giving rise to the claim and the identity of the debtor or should have become aware thereof without gross negligence.
The information we share when performing our services is based on the information provided by the parking lot providers. Therefore, they are independently responsible for the accuracy, completeness and correctness of the (descriptive) information (including tariffs, availability and booking conditions) shown on our website. We invest a lot of time and attention in offering our services but cannot be held responsible for this information's completeness and accuracy. Our website does not act as a seal of approval or review site. Therefore the offering made available should not be construed as a recommendation or review of the quality, level of service or classification of the parking facilities. It is not permitted to resell, copy, deep-link, use, reproduce, display or download (content) any information, software, products or services offered on our website for any commercial or competitive purpose or activity.
Parkifind.de is liable
- in the full amount of damage in the event of gross negligence on the part of their bodies and executives,
- basically, in the event of any culpable breach of essential contractual obligations,
- Outside of such duties, also for gross negligence on the part of simple vicarious agents, unless Parkifind.de can exempt itself from this by commercial usage,
- in the last two groups of cases, compensation for typical, foreseeable damage.

Contributory negligence on the part of the customer is to be taken into account.

Liability for intent, guarantee, fraudulent intent and damage to health and personal injury, as well as under the Product Liability Act, remains unaffected.

10 Application of the General Terms and Conditions

These terms of use apply to all contractual relationships between the car park operator and Parkifind.de in connection with the use or utilization of the website. Any deviating terms and conditions of the car park operator do not apply, even if Parkifind.de does not expressly object to them.
Parkifind.de reserves the right to amend or supplement the terms of use at any time with effect for the future. For the car park operator, the data at the time of registration on parkifind.de applies unless Parkifind.de has sent the car park operator notification of a change in terms of use with the option to object to the changed terms of use within a reasonable period. The car park operator has not declared an objection within this period - in this case, the changed terms of use for the car park operator apply from the end of the objection period. The car park operator is informed of this legal consequence in the notification of the change in terms of use.
The current terms of use can be viewed at parkifind.de. Parkifind.de stores older versions of the Terms of Use. Parkifind.de recommends that the parking lot operator print out or save the terms of use when registering on the Internet portal for his records to avoid misunderstandings.

11 Force majeure

If parkifind.de cannot provide the service owed due to force majeure (particularly war or natural disasters), parkifind.de is completely released from its performance obligations for this duration.
If parkfind.de is unable to perform the booking services offered for more than one month due to force majeure, the customer is entitled to withdraw from the agency contract.

12 Final Provisions

Contract language is German, German law applies here, the currently valid version of the German Civil Code.
Should a provision of these conditions be or become invalid, the respective statutory regulation shall take its place.

The place of jurisdiction for legal disputes is Stuttgart.
